Changes to Fire and Safety Regulations
On 27 October 2003, new Regulations came into force amending the Fire Precautions (Workplace) Regulations 1997 and the Management of Health and Safety at Work Regulations 1999. Whilst confirming the rights of employees to claim damages from their employer in a civil action, where they suffer injury or illness as a result of the employer breaching either the Management of Health and Safety at Work Regulations 1999 or the Fire Precautions (Workplace) Regulations 1997 these new regulations also introduce reciprocal rights for employers who are now able to bring actions against employees for breaches of their duties under the 1999 Management of Health and Safety at Work Regulations 1999. The Government and the Health & Safety Commission believe that these new Regulations will send a powerful signal to industry about the seriousness of the Government's intentions to raise further the profile of occupational health and safety.Employers may want to take this opportunity to remind their employees of their personal duties and consider amending their Health and Safety Policies.
